Lois Lerner, the ex-top IRS official at the center of a controversy over targeting conservative groups for tax-exempt status who invoked her Fifth Amendment right not to incriminate herself in front of Congress last week, can still be subpoenaed. The House Oversight Committee announced that it will ask the Department of Justice to investigate whether she committed perjury in 2012 before testifying about what happened under former president George W. Bush’s administration during his 2008 reelection campaign. The committee has already issued three contempt citations against Ms. Lerner and her deputy, Nikole Flax , who also testified without permission on May 22 when their refusal to answer questions was called an “affront” by Chairman Darrell Issa (R., Calif.).
