Small claims court is also known as “court of general jurisdiction” or “common pleas court.” It is a trial-level civil court that handles only cases involving amounts under $25,000.
How much can I sue for?
The limit in small claims courts in Newaygo County is $15,000; this amount includes both compensatory and punitive damages (if you succeed in your lawsuit). The limit in circuit courts (appellate) and supreme courts (trial) is either twice or three times the amount sued for. You cannot recover attorney fees unless the other side agrees to pay them at the end of the case. Most litigants settle out of court before reaching this point anyway–see our section on settling cases below.
